DearDiary.Net... Terms and Conditions

The following terms and conditions apply to all users of the DearDiary.Net... System

The term DearDiary.Net... Administration is defined as any or all officers or agents, authorised by Kabarty Ltd, to carry out any and all forms of site related administration.

In the event of any query, or complaint relating to the DearDiary.Net... Administration or these Terms and Conditions, or breach thereof by a user of the DearDiary.Net... site, please write to abuse@deardiary.net giving as much detail as possible.

Authors of diaries published at DearDiary.Net... must abide by the following terms and conditions at all times;

Authors of Diaries;

  1. Diary entries must not contain any illegal references as defined by the laws of the United Kingdom. Such references include, but are not limited to, software piracy, copyright infringement, racial or other hatred, defamatory or abusive statements about or to others. The term 'references' include pictures, links to other sites or sentences.
  2. Diary entries must not -link- to the following types of site;
    • Sites that contain illegal activities as defined by the laws of the United Kingdom and United States of America.
    • MP3 sites
    • Warez, Serialz or other forms of Software Piracy sites
    • Adult sites.
    • Banner advertisement systems.
    • Other commercial links, where such links constitute the majority of a diary or entry.
    Diaries kept at DearDiary.Net... may not participate in any advertising program for commercial gain.
  3. Diary entries must not publish details of individuals that may identify them (either in an online or real life fashion) unless the diary author has written permission from the individual that could be identified and can prove this to the DearDiary.Net... Administration. Such identities may be construed as (but not limited to) First and Last names, Names and Addresses and/or Names and Telephone numbers.
  4. Authors may not post defamatory entries that name, either by implication or explicitly, other diary authors. Such entries will be deleted without notice and repeated offences under this clause can result in any or all accounts held at Kabarty being removed and your permission to use the system revoked (see clause 10). There is no scope within this clause for determining 'who started it', as any diary entry that violates this clause will be subject to the remedial action already specified, regardless of 'who started it'.
  5. Diaries which contain mostly erotic material, or are written purely to arouse a sexual response from readership MUST appear under the Adult Genre. Diaries who's content is considered primarily erotic in nature will be moved into the Adult genre if they do not already appear there. If they are moved from the genre without the erotic content being deleted they may be deleted and access to the system removed. This is to protect you as a diarist, since this site provides Age Checking and Verification features for the Adult Genre, and it is illegal in most countries to provide erotica to minors.
  6. The storage of diary entries is entirely at the discretion of the DearDiary.Net... Administration and entries may be removed (though they may not be otherwise modified) by the DearDiary.Net... Administration at any time and without reason or notice, though usually reason and notice would be given to the email address registered with the account.
  7. The content of all Diary Entries remains the property of the diary author at all times and may not be used by anyone without the express written consent of the diary author. This includes the DearDiary.Net... Administration.
  8. The Author of The Diary assumes all responsibility for the content of their Diary. The Author agrees that the DearDiary.Net... Administration are in no way liable for any content written by The Author and furthermore agrees to indemnify the DearDiary.Net... Administration against any form of liability, assuming total responsibility for their entries.
  9. The author understands and agrees that the DearDiary.Net... Administration can not be held responsible for any loss, howsoever caused, as a result of ability or inability to use the service whether for reading or composing of diaries and furthermore that the DearDiary.Net... Administration can not be held responsible for any direct or indirect loss, whether of direct earnings or intangible loss as a result of other users actions within the system, unless such action has previously been notified to the DearDiary.Net... Administration with 7 days notice in writing and is within the control of the DearDiary.Net... Administration.
  10. Various security measures are in place to protect the data held on the DearDiary.Net... servers. Under the UK Computer Misuse Act of 1990, you must NOT attempt to circumvent these security measures, or attempt to find/use/abuse information for which you were not explicitly authorised.

    You are hereby authorised to use this system (subject to the terms and conditions, of which this is one) for the storage of your own personal diary entries, and use of the Web site at www.deardiary.net for the creation and storage of your diary, unless otherwise notified by email to the address that is registered as the 'private address' for this purpose.

    If your authorization is subsequently revoked (which is only likely for repeated violations of these terms and conditions), you must stop using the system, in any way, or risk prosecution. Offences under the Computer Misuse Act 1990 are criminal offences and may carry a jail sentence or a large fine.

  11. This policy is subject to change at any time. An up to date copy of this policy is available at www.deardiary.net/aup.html. The version available at the aforementioned place is deemed to be the master copy and supersedes all others.

By publishing any material on the DearDiary.Net... servers you agree to be bound by the 11 rules listed above. Failure to abide by the rules above could result in the irrecoverable removal of any or ALL diary entries from the DearDiary.Net... server, and/or removal of any or all of your Kabarty accounts in general.

Readers of Diaries;

Readers of diaries published at DearDiary.Net... must abide by the following terms and conditions when they leave comments on diary entries published at the site;

  1. Comment authors must not publish details of individuals that may identify them (either in an online or real life fashion) unless the comment author has written permission from the individual that could be identified and can prove this to the DearDiary.Net... Administration. Such identities may be construed as (but not limited to) First and Last names, Names and Addresses and/or Names and Telephone numbers.
  2. Comments left may refer to the author of the particular entry, but they may NOT refer in any derogatory way to another diary author. If you wish to say something about another author, do so at their diary, not a third person's. Comments left that slander diarists other than the author of the diary on which the comment is left, may result in any or all Kabarty Accounts being removed, and your permission to use the system being revoked (see Clause 10 above).
  3. Comments left must not contain references, pictures or hyperlinks to illegal activities. Illegal is defined as the superset of activities that are considered illegal under the laws of the United Kingdom and the United States. Specific examples can be found by referring to the Authors of Diaries section, though the examples are not limiting.
  4. The Comment Author assumes responsibility for their comment, neither The Diary Author nor the DearDiary.Net... Administration will be liable.
  5. DearDiary.Net... has various security measures in place which can be used to restrict comment authors ability to post to a particular diary. If your user account is banned from posting to a particular diary, you MUST NOT create a seperate account in order to circumvent the diary authors wishes. Failure to observe this condition can result in any or all accounts held on the Kabarty System network being removed and measures will be taken at higher levels to block your access to the sites.

In the event of dispute between a DearDiary.Net... reader and author, the author agrees that the DearDiary.Net... Administration have the right to temporarily or permanently and at the discrection of an officer of Kabarty Ltd, remove any or all of the offending articles. Articles may refer to reader comments or diary entries.

All users agree to indemnify the Dear Diary... Administration against any legal issues that may occur as a result of their publications on the DearDiary.Net... system. Publications can mean diary entries and their contents, or reader comments.
